Consolidation Facing Sweeping Reforms

"This is the last opportunity for borrowers to reconsolidate if they have loans that have already consolidated," Paul J. Simino said. "It's the last chance for a lot of borrowers who are in school to consolidate their loans. Those are going away July 1 with the Deficit Reduction Act that President Bush just signed into law on Feb. 8."

OneSimple Loan Challenges the Dept of Education

The United States Supreme Court roday refused today to consider OneSimpleLoan's 2005 lawsuit against the Education Department. However, OneSimpleLoan’s president and chief executive, Paul J. Simino, nevertheless is claiming victory, saying the publicity generated by his lawsuit had helped persuade Congress to repeal the “single-holder rule” in 2006, thereby allowing any lender to consolidate a student’s loans through the federally guaranteed program — not just one of the lenders holding one of the student’s original loans.

Paul J. Simino, president of OneSimpleLoan in Oldsmar, has filed a lawsuit in the U.S. District Court for the Southern District of New York against the Department of Education and Secretary Margaret Spellings. The lawsuit requests a temporary injunction against a ruling that eliminated some consolidation options on March 31, three months before the July 1 deadline.
